Construction Mediation Overview

 

Construction is an industry where conflicts are inevitable. Construction projects often take many months and possibly years to complete, involve multiple contractors, subcontractors, suppliers, designers, and developers.

Here the parties may have to continue working together on a project, which may be midstream in its completion when a dispute occurs. In the event of a dispute it is important to have an efficient conflict resolution system in place to help maintain relationships between the parties, and find areas of agreement in a way that would never be possible in court. In many time it is advantageous to maintain their relationship for the success of the project and for future engagements

This course explores the practical considerations of the construction mediation process including; the suitability of the case for mediation, the parties to the process, preparing for the mediation, negotiations during mediation, discussion of settlement, and the ever changing role of the construction mediator.
