Course Details

Construction is an industry where conflicts are inevitable. Construction projects often take many years to complete, involve multiple contractors, subcontractors, suppliers, designers, and developers. Each party has a vital role in the ultimate success of the project.

It is important to have an efficient conflict resolution system in place to help maintain relationships between the parties. Here the parties may have to continue working together on a project, which may be midstream in its completion when a conflict occurs. Also the parties frequently want to maintain their relationship for future projects, and find areas of agreement in a way that would never be possible in court.

This course explores the practical considerations of the construction mediation process including; the suitability of the case for mediation, the parties to the process, preparing for the mediation, negotiations during mediation, settlement discussions, and the ever changing role of the construction mediator.
